PCD has accused a factory of committing an offencein accordance with the Factory Act.

Mr. Athapol Charoenshunsa, Director General of Pollution Control Department (PCD), revealed that according to the complaint of Chachoengsao Province, the Province sent the letter requesting PCD to join inspecting the factory operation of the THH Molyprocessing Co., Ltd. located at the 304 Industrial Park,  Moo 3, Khoahinsoen Sub-district, Panomsarakam District, Chachoengsao Province in case of industrial waste dumping problem in the 16th reservoir of Nam Jon Basin located on Khoahinsoen Sub-district, Panomsarakam District, Chachoengsao Province since B.E. 2562. In this regard, H.E. Mr. Varawut Silpa-archa, Minister of Natural Resources and Environment (MONRE) has commanded PCD to follow up on legal action until all executions are completed in order to resolve people’s trouble problem and protect the environment.

Mr. Athapol said that according to the inspection of the Environmental Protection Unit, PCD, we have acknowledged the fact that the factory operation of the THH Molyprocessing Co., Ltd. seemed to be considered the guilt in accordance with the Factory Act, B.E. 2535 and the Public Health Act, B.E. 2535. These included (1) There was the construction of wastewater treatment facility without informing the permitting person; and (2) There was the discharge of effluent from factory operation, which its value did not complied with the legal standard, throughout the rain gutter of the 304 Industrial Park Project 2 into the environment without collecting to the central wastewater treatment facility of Industrial Park. However, the factory operation permitting criteria determined that its total effluent must be discharged into the wastewater treatment facility of the 304 Industrial Park 2 Co., Ltd. which the effluent might cause damage and danger to the outside environment. Moreover, the factory operation of the Company might be also harmful to health in accordance with the Public Health Act, B.E. 2535. Therefore, the discharge of industrial effluent of the Company into the environment which its value did not complied with the legal standard might be the guilt in accordance with the Public Health Act, B.E. 2535 as well.

“In order to protect the environment and strongly take legal action to the offender, PCD has assigned Mr. Pitaya Pramotvoraphan, Director of Legal Division to accuse the Factory of committing an offence to the inquiry officer of the Natural Resources and Environmental Crime Division to investigate and arrest the offender for punishment later” Mr. Athapol said.
